The Oregonian reports: “Terri Horman agrees to limited evaluation for parenting time with daughter”

Terri Moulton Horman agrees with her estranged husband’s request that an expert should evaluate whether she should have any parenting time with the couple’s 4-year-old daughter, Kiara, court papers say.

But Horman, who has been a focus of the criminal investigation into the June 2010 disappearance of her stepson, Kyron, would seek limits on such an evaluation, her attorney Peter Bunch wrote in a filing earlier this month in the Hormans’ divorce case.

Police have not provided Terri Horman with information about their investigation, Bunch wrote, and she should not have to answer questions that could affect her constitutional rights.

Terri Horman was the last person known to have seen Kyron, her stepson. That single fact has been enough for the press to pursue a witch hunt against her, seemingly working at the police’s behest to do their dirty work: to apply enough pressure so that Terri Horman cracks and confesses. Only, she denies any involvement in the child’s vanishing. The police have nothing else. She has not been “a focus”. She has been the focus. As a result of monocular policing, the investigation has gone nowhere.

The Sheriff’s Office’s mouthpiece seems to be the Oregonian, in the person of Maxine Bernstein, who it appears, has rather exclusive access. She has been remarkably unequivocal in publishing whatever information she is given, without asking any particularly hard questions. Some of the articles and information published have been unquestionably ruinous to the reputations of Terri Horman andsome of her associates. Ms. Bernstein is conceivably comfortable doing this, based on First Amendment protections, and assurances that she has received solid information from the authorities

Our sources claim that Bernstein is being fed information supportive of Kaine and Kyron’s birth mother, Desiree Young, and ignoring documents from Terri Horman’s side. Moreover, it’s alleged that papers from Terri’s team are not filed in a timely fashion.

We do know for certain that stories in the Oregonian have been changed with no explanation as to why.

Helen Jung adds:

Still, she [Terri] supports the idea of reviewing possible ways she could see her daughter, the filing states. Kiara has been living exclusively with her father, Kaine Horman, for the past three years.

“Husband took it upon himself to essentially terminate Wife’s primary parental role with Kiara Horman,” the filing states. “Wife anticipates that an evaluation will support her contention that Husband’s actions were not in Kiara’s best interests.”

The filing comes about two weeks after Kaine Horman submitted his request asking the court to order an evaluation that investigates “the character, family relations and past conduct” of the two parents and for a mental health and psychological evaluation of Terri Horman.

“So far she has chosen her privilege against self-incrimination over a relationship with her daughter,” Kaine Horman’s lawyer, Brett Engel, wrote. “It is anticipated she will now seek to establish a relationship with Kiara. The risk of physical and/or emotional harm to Kiara is high.”

But there is not a shred of proof that Terri Horman would harm her child. To British readers steeped in libel laws the lawyer’s comments are egregious.

Those gloves were never on – but if they were Kaine’s contained a horseshoe branded “Property of Multnomah County Sheriff’s Office”. When Kaine was told by police that Terri had hired a gardener to kill him seven months before the child vanished, the police set up a sting in which they were well and truly stung (she called the police as the landscaper attempted to blackmail her). Oddly, Kaine was able to use this alleged murder plot to file divorce papers, a petition for a restraining order against his wife and take the couple’s then 19-month-old daughter.

No-one asked why might she have wanted him dead?

But Terri’s lawyer Peter Brunch noted:

“There are a number of troubling aspects of husband’s prior conduct and parental decision. Husband and the police have perpetuated the dissemination of inaccurate information about the circumstances of the disappearance of Kyron Horman.”

The alleged murder plot served to unite Kaine with Kyron’s mother, Desiree Young, and her husband, Medford police Detective Tony Young, and ostracise Terri Horman. Soon after, Desiree and Tony Young called a news conference at police headquarters in Medford – where he works.

Things were said. Kaine called Terri an “emotionally disturbed individual focused on her own needs rather than the needs of Kiara or my missing Kyron”. Terri Horman’s attorneys say Kaine Horman is focused on his wife’s destruction rather than their daughter’s best interests. Desiree Young stated that Terri had kidnapped the boy.

On November 2 2010 Terri Moulton Horman withdrew her motion seeking parenting time with daughter Kiara. The parenting issue is linked to the investigation. This is what Kaine states in his restraining order:

“My son, Kyron, has been missing since June 4, 2010. I do not know where he is, if he has been harmed, or if he is alive. Local and federal law enforcement agencies are currently investigating my Wife, Respondent/Terri Horman, for her involvement in Kyron’s disappearance. Terri Horman will not cooperate with law enforcement and will not assist in the search for Kyron. I believe that Terri Horman is responsible for Kyron’s disappearance.

“After Kyron went missing and the investigation began, law enforcement officials informed me that my Wife had attempted to hire our landscaper to kill me for money. I obtained a restraining order against her to protect myself and my daughter Kiara. Respondent/Terri Horman is a substantial safety threat to me and to my family. She has manifested a desire to physically harm me and my family, and I fear she will continue to try to harm me and my family.”

The investigation appears horribly compromised. With police money too tight, the reward was upped (to $50,000) and the pressure on Terri Horman intensified. Theory became fact. Get this from Yahoo:

Terri Horman initially flew under the radar when her 7 year old stepson, Kyron Horman went missing on June 4, 2010. Her strange behavior and lack of cooperation with the police eventually led her husband, Kaine Horman, to suspect her in the disappearance of his son. Police eventually told, Kaine Horman and Desiree Young (Kyron’s Mom), that Terri had hired a landscaper to kill Kaine months before Kyron went missing. The landscaper did not follow through with the plan.

No. It was an alleged plot based on the word of one unnamed man and quickly believed by a desperate police force.

So. Has Terri Horman attempted to contact her daughter? Did she and her lawyers attempt to contact Kaine Horman to arrange parenting time? Anorak’s sources claim she did. Our sources also claim she was denied supervised visits.

In 2010, Peter Bunch noted after that aforesaid withdrawal:

“Respondent wishes only to act in Kiara’s best interest. Respondent does not, and will not, give up her right to seek legal custody and unfettered contact with Kiara. Petitioner’s efforts to withhold all parenting time is completely contrary to Kiara’s healthy development. However, under all of the circumstances, issues regarding parenting time will need to wait for another day, when additional facts can be obtained and presented.”

It’s ugly. And no-one seems to be looking for the missing child or seeking answers from anyone other than Terri Horman.
